New Orleans,  La. - The state Supreme Court rules a Saint Bernard Parish judge must hear a lawsuit which claims a temporary service fee charged on residents' water bills was against the law.

Peter Rupp, a St. Bernard parish resident, is suing Parish President David Peralta and all the parish council members.

Last year, the council decided a 32 dollar fee should be added to residents' water bills for four months to pay for fire protection.

Rupp says the fee violated the Louisiana local government budget act, the parish charter and the Louisiana and United States constitutions.
