Cut Off, La. - A Mexican National has been arrested and charged with killing his girlfriend's 20-month-old son. 24-year-old Emmanuel Hernandez was booked late Tuesday night with 2nd degree murder after being transferred from the custody of immigration officials.

Lafourche Parish Sheriff Craig Webre says Hernandez was living with his girlfriend and her son in the 200 block of West 59th Street in Cut Off. On May 15, the baby, identified as Emmanuel Gonzales was taken to a local hospital with breathing issues. He was then transferred to Pediatric Intensive Care Unit at Children's Hospital of New Orleans, where he was put on life support. Hospital workers at Children's Hospital noticed some injuries and ailments consistent with Shaken Baby Syndrome and called the Lafourche Parish Sheriff's Office.

During the investigation, Immigration and Customs Enforcement agents determined Hernandez did not have legal residency in the United States and detained him.

The child was eventually removed from life support over the weekend. Following further investigation into the incident, detectives obtained a warrant for Hernandez's arrest for the 2nd degree murder of Emmanuel Gonzales. Hernandez was transported to the Lafourche Parish Detention Center on Tuesday night and booked as per the warrant. He is now being held in lieu of $1 million bond as set by Judge F. Hugh Larose. The investigation into this case is continuing.
