Nagin attorney argues for dismissal

New Orleans, La. - With the trial of former Mayor Ray Nagin set to begin in just 12 days, his attorney went before a federal judge Thursday arguing for a dismissal.

Attorney Robert Jenkins is also seeking several other concessions in a case that's been brewing for years.

Jenkins met with Judge Helen Berrigan for 45 minutes and very few decisions were made.

"Both sides are preparing. That's all we can do," said Jenkins.

Nagin's attorney appears to be committed to try and push prosecutorial misconduct issues. The big question now is whether he will have time to file an appeal depending on when Judge Berrigan comes back with a decision as to whether or not they will be allowed in at trial.
