NEW ORLEANS, LA (WVUE) - St. Bernard Parish president Dave Peralta and his estranged wife were back in court Wednesday morning, but it was Dave Peralta who walked out with a victory.
His wife's protective order was dismissed.
Sharon Peralta filed the protective order in New Orleans where she now lives. She alleges Dave Peralta sexually assaulted her last year and that she fears for her safety. Her attorney argued in court that she is afraid to return to St. Bernard Parish.
Still, Judge Regina Bartholomew sided with Dave Peralta's attorneys who said Orleans Parish civil court was an improper venue.
Because the divorce filing was made in St. Bernard, the protective order issue must be heard there. However, Sharon Peralta's attorney is filing a motion to bar all five St. Bernard judges in the 34th Judicial District Court from presiding over the case.
