These changes were recently evidenced by two recent patent litigation decisions handed down by the Supreme Court in which the legal rights of certain patent holders were questioned. In the first case, Nautilus Inc. v. Biosig Instruments Inc., The Supreme Court ruled that patent inventor(s) need to describe the essential elements of their invention and its use with enough clarity that a person skilled in the field could understand it with "reasonable clarity." The New York Times reports that the decision served to reverse a ruling by the U.S. Court of Appeals for the Federal Circuit that had originally concluded that a patent could be valid as long as the description of what it claims to do was not "insolubly ambiguous."

In the second case – Limelight Networks Inc. v. Akamai Technologies, Inc. – the Supreme Court overturned a ruling from the appeals court that a patent that had covered a series of steps was not infringed upon if no one person or business carried out all the steps. Essentially, Akamai had accused its competitor, Limelight, of infringing a patent that covered a multipart method Akamai uses to transmit videos and other content to Internet users through services like Yahoo!. Since Limelight only carried out some of the steps in the patented technique, the Supreme Court ruled that it could not be held liable for infringement.
