Trung Le, the only person arrested in the Bourbon Street shooting investigation, is asking once again to move his preliminary hearing to an earlier date.
A state appeals court has been asked to move up Le's hearing.
Last week, Magistrate Judge Harry Cantrell refused to move it up from August 26.
The judge also denied a defense attorney's motion to subpoena videos from French Quarter businesses.
One person was killed and nine others injured in the shooting. Police are for a second shooter. Le has been charged with first-degree murder and nine counts of attempted murder.
