Judge denies contempt of court motion in Peralta case

CHALMETTE, LA (WVUE) - A judge ruled against Saint Bernard Parish President Dave Peralta Monday afternoon in his attempt to have his ex-wife and her civil attorney held in contempt of court.

Peralta is set to go on trial in Saint Bernard Parish in March for alleged sexual battery of his former wife Sharon Schaefer. He faces another trial in Saint Tammany Parish for allegedly stalking Schaefer after they became estranged as husband and wife.

In Monday's court hearing, Peralta's attorney Martin Regan asked the judge to hold Schaefer in contempt for talking to the media after Peralta was indicted in September in the stalking case. And Peralta wanted Schaefer's attorney Stephen Rue held in contempt for talking to reporters after he filed a civil suit against Peralta in October.

Rue took the stand and said he was unaware of a gag order when he talked to the media about the civil case.

In December, Schaefer said she was under the impression that the St. Tammany case was not affected by the gag order in the sexual battery case.

The judge said the gag order applies to all of the cases, but denied Peralta's contempt of court motion.
