Tom Benson's lawyers argue Texas judge abused power

Attorneys for Tom Benson say a San Antonio judge abused his power when he decided to temporarily remove Benson as a manager of his family assets.

The comments came last week during a brief filed with a Texas appeals court, according to our partners at Nola.com/The Times Picayune.

Tom Benson's lawyers say the court made the announcement without any evidence.

The Texas judge in February gave former San Antonio Mayor Phil Hardenburger and estate lawyer Art Bayern temporary control of Benson's assets in Texas.

Benson's daughter and would-be heir Renee Benson argues that her 87-year-old father had mismanaged the assets and is declining in mental health.
