Witness video of Will Smith shooting scene

NEW ORLEANS, LA (WVUE) - Moments after police say 28-year-old Cardell Hayes shot former Saints defensive end Will Smith to death, a witness began recording the scene on his cell phone.

Police say just before the shooting, Hayes and Smith exchanged words when Hayes, driving a Hummer, rear-ended Smith's Mercedes SUV. You can hear a witness describing to the person recording what he heard just before the shots rang out.

Witness: "He started freaking out on this guy."

Camera: "Uh-huh."

Witness: "And they're like, we're gonna fight you."

Camera: "Yeah"

Witness: "And then he's like, because this guy's like, 'get out of here or I've got a gun.' And then he's like, '(expletive) you, I got one too.' And then he grabs the gun and he shoots him in the back and he's dead."

According to Hayes' arrest warrant, homicide detectives found Smith lying partially inside of his vehicle. He was shot in the back and right torso. His wife, Racquel, was shot twice in the right leg.

On the video, you can hear a woman screaming in the background.

Woman: "I need an ambulance. My leg has been shot."

"It was terrible. I don't know if it was road rage or what," says Michael Ferrell.

Ferrell says he walked up to the scene just moments after the collision.

"Some people got out of both vehicles and started arguing, and the last thing I heard was something about my car and then I heard a bunch of shots," says Ferrell.

Ferrell says he heard five shots. Hayes remained on the scene. You can see him being arrested in the cell phone video.

"We have reason to believe there may have been a second gun on the scene, and there's definitely illusions of a second gun," says defense attorney John Fuller.

Fuller said Hayes was not the aggressor.

"I fell that there have been some things withheld from the public in terms of what was uncovered and unearthed at the scene," says Fuller.
