NEW ORLEANS, LA (WVUE) - The Orleans Parish grand jury finished meeting for the day Thursday. A source close to the defense told FOX 8 that witnesses were subpoenaed to testify today in the in the Will Smith shooting case.
One of those witnesses, we're told, was Kevin O'Neal, the man who was in the Hummer with Cardell Hayes on April 9. The grand jury meets in secret, so it's unclear when the they will meet again but, there was no indictment in the Smith case Thursday.
Police have said Hayes rear-ended Smith's SUV and the two exchanged words. They say Hayes shot Smith eight times. His wife, Racquel was shot twice. Hayes' attorney has said his client was not the aggressor. The Smith family attorney says Hayes intentionally killed Smith and shot his wife.
Defense attorney John Fuller subpoenaed Pierre Thomas and reserve NOPD officer William Ceravolo to testify before a preliminary hearing next week. If Hayes is indicted before then, the hearing will likely not happen. Hayes remains locked up on a one million dollar bond.
