Will Smith's blood alcohol level was 3 times legal limit during shooting

NEW ORLEANS (WVUE) -

Will Smith's blood alcohol level was three times the legal limit when he was shot to death in April in the Lower Garden District.

The toxicology results have not been made public, but a source said Smith's blood alcohol content was 0.24 percent. Louisiana's legal limit is 0.08 percent.

Cardell Hayes is accused of shooting Smith and his wife after a crash late that Saturday night. Smith died on the scene. His wife was sent to the hospital, where she recovered from her wound.

Hayes' attorney said the shooting was in self-defense.
