NEW ORLEANS, LA (WVUE) - A man shot by a homeowner last week as he was running from an alleged burglary has died.
The coroner identified the man as 53-year-old Benny Weary, who died of a gunshot wound.
Investigators said homeowner Abraham Venson allegedly caught two men inside his garage on Gallier Street on the morning of Sept. 28 and opened fire on them as they fled.
Police did not find a weapon on the intruder.
Venson was booked with aggravated battery.
The NOPD released a statement saying that the Homicide Division is now in charge of the ongoing investigation, but no additional charges have been filed.
