Man accused of shooting intruder to appear in court

NEW ORLEANS (WVUE) - A New Orleans homeowner who police say shot and killed an intruder is scheduled to appear in Orleans Parish Criminal Court today.

Abraham Venson, 73, is accused of killing 53-year-old Benny Weary last month in the Upper Ninth Ward.

Venson says, he found Weary and another man in his garage and that the pair ran.

Venson says he yelled at them to stop and opened fire when Weary turned around and reached for his waistband.

Police did not find a weapon on Weary.

People who live nearby say this isn't the first time Venson's garage has been broken into.

They think he may have just been fed up.

"It is pretty wrong for someone to think they can just break into your house and nothing is going to happen," one neighbor said.

"This is going to be a very tough prosecution if it ever gets that far," said Fox 8 Legal Analyst Joe Raspanti. "There's a lot of sympathy that would be paid out to this man."

Records show Venson is charged with one count of aggravated battery.
