Surveillance video sheds light on Marigny altercation

NEW ORLEANS (WVUE) - A surveillance video sheds new light on an altercation in the Marigny that left a tourist paralyzed.

Our partners at | The Times-Picayune obtained the video from Christopher Smith's attorney, which was recorded by business near the intersection of Frenchmen and Decatur streets.

The video shows tourist Doug David crossing the street when a car passes. David can be seen throwing an object at the car.

The video stops before the driver of the car, Smith, can be seen getting out and punching David twice.

Smith's attorney released the video saying he didn't include the footage of the punches out of respect to David.

The punches sent him to the ground.

He is now paralyzed from the neck down.

David says he threw a beer can at the car, but Smith's attorney says it was a bottle.

Smith is charged with second-degree battery. He was to go on trial this month but it's been pushed back to February because David's paralysis makes traveling difficult.

The video may play a key role in this case when it goes to criminal court.
