NEW ORLEANS (WVUE) - The man convicted of killing former New Orleans Saints star Will Smith filed a civil suit Monday against Smith's widow, Raquel, and another man who was at the scene of Smith's killing.
The suit, filed by Cardell Hayes' attorney, John Fuller, seeks an unspecified amount of damages stemming from Smith's actions leading up the moment he was shot and killed by Hayes.
The suit names Raquel Smith, Richard Hernandez and their insurance companies as defendants.
Hayes claims Hernandez came at him and tried to assault him after an accident.
Hayes also claims that Smith threw a drink in his face and then punched him in the face.
The suit then claims that Smith retrieved a gun from his car and fired several shots at Hayes.
The suit seeks an award for damages including property damage, medical expenses, lost wages, mental anguish, severe emotional distress, and loss of enjoyment of life.
A hearing date has not yet been set.
