NEW ORLEANS, LA (WVUE) - Attorneys for the man accused of killing former Saints player Will Smith have requested a new trial based on what they say is newly discovered evidence.
The motion comes one day before Cardell Hayes was scheduled to be sentenced. Hayes was convicted of manslaughter and attempted manslaughter in the case. Smith's wife, Racquel, was also shot in the incident.
It's now up to Judge Camille Buras as to what happens next. She could delay the sentencing or deny the motion.
FOX 8 legal analyst Joe Raspanti said it very unusual to request a new trial the day before sentencing, especially since it has already been continued twice.
