Man ticketed for warming up car loses in court

ROSEVILLE, MI (WXYZ/CNN) - A Michigan man fought a ticket for leaving his car running unattended in his driveway to warm it up, and lost.

Now his attorney is in trouble with the law too.

Taylor Trupiano and his attorney Nicholas Somberg were fighting a $128 ticket he received back in Jan. for leaving his car in the driveway.

"This ordinance only applies to areas open to the public and according to people v. Raya, you cannot even get a DUI in your own driveway," Somberg said.

That wasn't the only legal battle that went on in the court Thursday.

Things got heated after Somberg admitted to having someone broadcast the hearing on Facebook Live.

Somberg was held for contempt, and as for his client, the judge ruled in favor of the officer.

He said the ordinance said that it's accessible to the public, and since strangers can gain access to your driveway, that's included.

"I don't think it applies to your private property and on top of that if it's a safety issue they didn't solve the safety issue by leaving a ticket. The car was still running left unlocked," Trupiano said.

Someone paid Trupiano's ticket for him, but the court hasn't decided yet whether to accept the payment.
